Todd Sprinkle's practice includes all aspects of civil litigation, both state and federal, at the trial and appellate levels. Todd focuses on business litigation, financial services litigation, real property dispute resolution, trade secrets, and alternative dispute resolution.

His commercial litigation experience includes cases involving breaches of contracts, trade secrets theft, software implementation issues, and various business disputes. Todd advises clients through complex litigation, such as corporate dissolutions and ownership disputes. He has extensive experience representing Fortune 500 companies and automotive dealers as plaintiffs and defendants. He also represents financial institutions as plaintiffs and defendants with various litigation issues. He is experienced in recovering secured property and other collateral for lenders and lienholders.

In addition, Todd represents clients before federal and state courts in trade secrets and restrictive covenant disputes. He advises both employers and individual employees of large and midsize corporations related to the misappropriation or misuse of trade secrets and other employment-related disputes such as non-compete agreements.

In his real estate litigation practice, Todd represents national commercial real estate companies, real estate investment trusts (REITs), and lenders in all aspects of commercial disputes, such as landlord-tenant disputes, replevin actions, special assets, and real property disputes. He also represents national homebuilders and commercial landlords.

Representative Experience

Commercial Litigation

  • Obtained a judgment notwithstanding the verdict (JNOV) for New Hampshire Speedway Inc. resulting in a complete defense verdict. The case was tried on a promissory estoppel theory after we obtained summary judgment that the alleged contract at issue was illusory and therefore unenforceable. New Hampshire Speedway, Inc. v. Motor Racing Network, Inc., Merrimack, New Hampshire Superior Court Case No. 08-EQ-099.
  • Reached favorable settlement during trial in defense of trustee in dispute over administration of a mass tort settlement fund. 
  • Defended restaurant company in dispute with private equity firm over alleged securities violations.
  • Represented automotive dealerships in a wide variety of commercial disputes.
  • Successfully argued numerous summary judgment motions.
  • Successfully argued motion to dismiss for improper venue based on contractual venue and forum selection clause in contract.
  • Reached favorable resolution of business divorce case following dispute over corporate governance and ownership.
  • Obtained significant sanctions/damages award in e-discovery dispute in the NC Business Court.
  • Obtained plaintiff’s verdict in bench trial regarding dispute over software implementation.
  • Dismissal of all claims against Fortune 500 client in case pending in the Northern District of Georgia.
  • Successfully defended a leading global technology company in arbitration related to a claim of fraudulent inducement of a contract; the arbitrator ultimately awarded less than 1% of the $6 million the claimant sought in damages.

Real Property Dispute Resolution

  • Successfully defended national homebuilder in lawsuits involving alleged construction defects.
  • Prosecuted claims on behalf of national homebuilder over failure to deliver and develop contracts lots.
  • Successfully defended national homebuilder in dispute over stormwater erosion issues and obtained appellate decision in favor of client when plaintiff attempted to avoid a settlement agreement.
  • Successfully resolved disputes over earnest money in purchase contracts.
  • Represented commercial landlords in tenant disputes and summary ejectment proceedings.
  • Represented commercial landlords in suits to enforce lease obligations.
  • Obtained plaintiff’s verdict in bench trial for lender.
  • Obtained summary judgment for commercial landlord in dispute involving defenses related to the pandemic.
  • Obtained summary judgment in numerous cases representing commercial landlords in landlord/tenant disputes.

Financial Services Litigation

  • Successfully prosecuted special assets, collection, and SBA lending cases for national banks and obtained judgments or favorable settlements.
  • Successfully defended national banks against claims by commercial and consumer clients, and obtained summary judgments or favorable settlements.
  • Obtained the complete dismissal with prejudice of committee’s claim that our client, a mutual fund management company, was the alter ego of the debtors and therefore liable for all of the debtors obligations to the unsecured creditors.
  • Obtained summary judgment for numerous cases involving financial services companies.
  • Successfully represented lenders in suits to recover secured property and collateral in state and federal courts.
