Profile
Brent McConkey focuses his practice in the areas of local government, land use and regulatory law. He has experience in matters before state and local courts, boards and commissions representing public and private interests.
Mr. McConkey serves as the Town Attorney for Clayton, North Carolina and also serves on the Wake County Board of Adjustment, which hears and acts on appeals, variances and special uses in zoning cases.
Experience Highlights
- Obtaining zoning and subdivision approval, including special and conditional use permits, variances, rezonings and text amendments from local governments throughout the state
- Advising local governments and private interests on zoning and land use matters, public records, open meetings, eminent domain, annexation, the First Amendment, nuisances, ethics, public utilities, procurement and public contracts
- Representing clients before state regulatory agencies and occupational licensing boards, including the Department of Agriculture, the Board of Examiners of Electrical Contractors, the Board of Examiners for Engineers and Surveyors, the Alarm Systems Licensing Board and the Irrigation Contractors’ Licensing Board
- Monitoring state and federal legislation and court decisions impacting local governments
- Drafting ordinances, policies, procedures, franchises and local legislation
Representative Matters
- Obtained conditional use permits from two adjoining counties for a 300 megawatt wind energy facility
- Secured local government land development approval for diverse projects including wireless telecommunications facilities, hospital expansions, landfills, an adaptive reuse of a historic mill for mixed-use purposes, radio and television towers and a dog boarding and daycare facility
- Received approval of text change to the City of Raleigh Zoning Ordinance and subsequently secured special use permit for Raleigh’s first hospitality house for family members of local hospital patients
