Scott Efird represents commercial and residential developers, landlords and tenants in a variety of real estate projects, including the leasing, acquisition, development and financing of retail shopping center facilities, office complexes, mixed-use developments and residential subdivisions.

While at the University of Richmond, Mr. Efird was the Manuscripts Editor of the Richmond Journal of Global and Business Law.

Leasing

  • Preparing and negotiating commercial leases and subleases for retail, office and warehouse facilities
  • Counseling landlords and tenants on office and industrial projects, including future expansions and relocation alternatives
  • Preparing and negotiating subordination, non-disturbance and attornment agreements and tenant estoppel certificates

Development

  • Drafting and negotiating purchase and sale agreements and related documents, including easement and cost sharing agreements, joint venture agreements and development agreements
  • Representing national and regional developers in the acquisition, development and financing of properties throughout the Southeast, including commercial projects, manufacturing facilities and residential subdivisions
  • Structuring condominium and townhome regimes, including preparing restrictive covenants, architectural controls and other homeowner association documents
  • Analyzing title insurance policies, related title documents and endorsements
  • Reviewing due diligence items, including ALTA surveys, legal descriptions, Phase I environmental reports, construction documents and organizational documents
