Jeff Bandini focuses his practice on commercial, industrial and residential real estate acquisitions and development, the formation and management of planned communities and land use and zoning matters. He also advises clients on the development, operation and management of public infrastructure, with an emphasis on railroad, highway, water and sewer projects.

Experience

  • Represented national REIT in acquisition, leasing and management of medical office buildings in Raleigh and Cary, North Carolina.
  • Represented regional non-profit healthcare system in acquisition of property and negotiation of agreements with private developers for the construction and lease of satellite hospital facilities and medical office buildings.
  • Representing national homebuilder in due diligence, land acquisition, entitlements and homeowner’s association formation in development of a 500-townhome community within a mixed-use master planned development in Raleigh, North Carolina.
  • Representing equipment parts manufacturer on title, survey, acquisition and zoning issues in economic development incentive project in which manufacturer will acquire and redevelop existing construction equipment manufacturing facility in Buncombe County, North Carolina.
  • Represented partnership in land assemblage, acquisition and entitlements for a 1,200-acre, $120+ million planned unit development in Wendell, North Carolina. Components of the project included residential, commercial, retail, schools, public parks, a community center and public infrastructure improvements, including a dedicated interstate highway interchange.
  • Representing wind energy companies in acquisition of leases and easements for the development of new wind energy facilities in eastern North Carolina.
  • Representing national homebuilder on raw land and developed lot acquisitions, formation and management of homeowners’ associations and entitlements for single-family and townhome communities throughout North Carolina.
  • Represented partnership in land assemblage, acquisition, rezoning and entitlement and sale of grocery-store anchored shopping center in east Raleigh, North Carolina.
  • Represented world’s largest fertilizer company in a successful $19 million lawsuit against a Class I railroad in a dispute concerning the relocation of seven miles of railroad line in Eastern North Carolina to a new alignment at the client’s phosphate surface mine.
  • Represented international gypsum board manufacturer in land assemblage, acquisition, rezoning, and entitlements for a $160 million, 800,000-square-foot gypsum board manufacturing facility in Roxboro, North Carolina, which will reuse synthetic gypsum by-products from smokestack scrubbers at an adjoining electric power plant. The project included negotiation of a gypsum supply agreement with the electric utility and agreements for the relocation and improvement of rail lines to the site.
  • Represented regional transit agency in land acquisition for regional rail station areas and operating right of way and developed restrictive covenant regime for transit-oriented development at station areas. Representation included negotiation of a public/private partnership agreement with a real estate investment company for transit-oriented development around 13 rail transit station areas.
  • Represented City of Charlotte in right of way acquisition and negotiation of shared-use and operating agreements with Class I railroad for light-rail system. Negotiated transit-oriented development agreements with private developers for residential and retail projects adjoining right of way.
  • Represented national telecommunications tower companies and service providers in lease and easement negotiations and rezoning and special use permit approvals for tower sites and collocations throughout the Southeast. Appeared before elected officials, planning boards and boards of adjustment to present applications for entitlements and evidentiary support in both quasi-judicial and legislative hearings.
  • Represented commercial debris landfill owner in negotiation with Class I railroad and North Carolina Department of Transportation for temporary at-grade and grade-separated road structures across rail corridor.
  • Represented international steel manufacturer in right of way acquisitions and dispositions and negotiation of grade crossing agreements for rail yard relocation and redevelopment in Kansas City, Missouri.
  • Representing industrial clients in obtaining rail industrial access grants from the North Carolina Department of Transportation to improve rail sidings and lead tracks.
  • Representing clients in negotiations with North Carolina Department of Transportation on driveway permits, curb-cut and driveway closures, utility and encroachment agreements and condemnations.
  • Representing towns in acquisition and development of greenways and trails for North Carolina Mountains-to-Sea Trail.
