Profile
Matt Mall represents businesses and local governments in class action and other civil litigation in federal and state courts, including the North Carolina Business Court. Mr. Mall also has experience representing companies in both domestic and international arbitration. He has handled disputes involving First Amendment issues, fraud, healthcare fraud, insurance agents, surety bonds, employee raiding, breach of contract, and a variety of other issues. Recently, Mr. Mall’s practice has focused on disputes involving covenants not to compete and the North Carolina Trade Secrets Protection Act.
While in law school, Mr. Mall was a member of the William & Mary Law Review and actively participated in the William & Mary Trial Team. Mr. Mall was ranked first in his class for each year of law school and upon graduation.
Experience Highlights
- Argued before the District Court and the Fourth Circuit Court of Appeals to obtain $3.58 million federal court judgment for Brunswick County against insurance company on claim for unpaid subdivision bonds. See County of Brunswick v. Lexon Insurance Company, 710 F.Supp.2d 520, 2010 WL 1872551 (E.D.N.C. 2010), aff’d 2011 WL 1542517 (4th Cir. 2011).
- Defeated class certification in putative class action, leading ultimately to dismissal of all claims. See Audio-Video World of Wilmington, Inc. v. MHI Hotels Two, Inc., 2010 WL 6239352 (E.D.N.C. 2010).
- Obtained judgment on pleadings for Brunswick County in action seeking declaratory judgment.
- Obtained summary judgment and the dismissal of the resulting appeal for FORTUNE 1000 company on claims for unfair competition, constructive fraud, breach of contract and unjust enrichment.
- Represented and negotiated favorable settlement on behalf of insurance agents accused of fraudulent sale of annuity products.
- Assisted in successful affirmation on appeal of trial court order dismissing defamation and other claims. See Craven v. SEIU Cope, 188 N.C. App. 814, 656 S.E.2d 729 (2008).
