Parker Poe Assists NTE Carolinas, LLC with New Natural Gas Plant in North Carolina

Charlotte, NC – NTE Carolinas, LLC, an affiliate of NTE Energy, hosted a groundbreaking on July 28, 2015 for the Kings Mountain Energy Center (“KMEC”), a new 475 megawatt natural gas electric generating facility in Cleveland County, North Carolina. Eddie Poe and Fern Paterson of Parker Poe, attorneys involved with the opening of the plant, were honored to attend the ceremony.

Parker Poe worked with NTE Energy on this Greenfield facility providing advice and assistance in obtaining a fast-track, major source Prevention of Significant Deterioration (“PSD”) air quality construction permit. Ms. Paterson and Steve Weber of Parker Poe’s Environmental Practice Group worked closely with permitting staff at the North Carolina Department of Environment and Natural Resource (“NCDENR”) to expedite the PSD permitting process and obtain a final construction permit in time to meet key project objectives. Mr. Poe advised regarding purchase power agreements, North Carolina regulatory issues and numerous state and local law issues.

Once complete, KMEC will be one of the cleanest and most efficient energy sources in the Carolinas. KMEC will have the capacity to power approximately 400,000 homes. The project is located south of Interstate 85 off Dixon School Road in Cleveland County, representing an investment of over $440 million providing numerous benefits to the local communities and their economies. In addition to infrastructure improvements, the project will lower the cost of wholesale energy to the benefit of local businesses and residents over the next twenty years.
