Matt Wolfe was quoted in Law360 on a U.S. Supreme Court ruling that affects many hospitals who depend on Medicare reimbursement to offset their disproportionate care of low-income patients. The Supreme Court ruled the U.S. Department of Health and Human Services improperly made cuts to the Medicare Disproportionate Share Hospital (DSH) program without a notice and comment period.
"This decision will have a multibillion-dollar impact for thousands of hospitals across the country," Matt said. "Another significant aspect of the case is the Supreme Court’s strong defense of the importance of notice and comment in the rulemaking process, in particular under the Medicare Act."
Matt also noted that the ruling could lead to legal challenges to other statements of policy that HHS has published without undergoing notice and comment.
