Profile
James Davis focuses his practice on capital markets transactions. Mr. Davis represents mortgage portfolio servicers in connection with defeasances of Commercial Mortgage Backed Securities (CMBS) loans. He has represented institutional lenders and finance companies, as well as borrowers, in various financing transactions, including syndicated loans, loan assumptions, real estate financing and loan workouts and restructurings. Mr. Davis also has experience representing lenders in CMBS mortgage originations and in the origination of franchise loans for ultimate securitization. He also has experience in general corporate transactions.
While at Duke University, Mr. Davis was a Staff Editor of Law and Contemporary Problems.
Experience Highlights
- Representing mortgage portfolio servicers in defeasances, loan assumptions and on consent issues (including partial release, loan modifications, new leases and new easements)
- Representing lenders and borrowers in secured and unsecured working capital, term, acquisition and other credit facilities
- Negotiation of loan workouts and restructurings of existing loans
- Representing financial institutions as agents and participants in senior credit facilities for major utility holding companies including acquisition, term, working capital and letter of credit facilities
