Charleston, SC – Parker Poe Adams & Bernstein LLP, a business law firm with seven offices across the Southeast, today announced the publication of a book titled Treatise on the Law of Easements in South Carolina by Richard M. “Dick” Unger, a real estate partner in the firm’s Charleston, South Carolina office. The book addresses this technical area of South Carolina law, and it will serve as a comprehensive resource for both the public and private sector.

Published by the South Carolina Bar (SCB), Treatise on the Law of Easements in South Carolina serves as a decision-making and drafting guide for easements and pleadings as well as a resource for in-house counsel, real estate property practitioners, and title insurance agents. Bankers, surveyors, foresters, abstractors, state and local government road right-of-way agents, and landowners will also find it beneficial in better understanding all easement law complexities. The book will be introduced by Mr. Unger at the SCB’s Continuing Legal Education program “Easements: What are they? Where are they now and where are they going?”  to be held in Columbia, South Carolina, on Tuesday, Feb. 21.

The seminar will feature a distinguished panel of practitioners from across the State and Georgia, who are members of the editorial board for the book, including the panel chair, the Honorable Mikell R. Scarborough. The panel will discuss the topics set out in the book and then answer questions from Judge Scarborough and the audience.

Designed to provide a thorough history and analysis of the law of easements in South Carolina, the book also discusses developments in laws in neighboring states. Key existing appellate decisions and discussions are highlighted, and accompanying illustrations help chart the reasoning of the court in the decisions.

“Easements impact real estate transactions every day, from small, personal land interactions to commercial-scale developments,” said Unger. “Today’s practitioners need to stay informed on legal casework and regulatory changes. I was thrilled and honored when SCB asked me to compile this much-needed reference guide.”

Jud Smith, president of MJS Inc., said, “As the manager of more than 150 property owners associations in multiple cities in South Carolina, MJS Inc. is frequently called upon to address and explain the ramifications of and identify easements that affect our associations and the lot or unit owners in our communities. A definitive publication written by an attorney with significant experience in this area of the law that explains easements, the rights and obligations created by them, their scope and how they affect real property, is an invaluable tool for both me and my staff.”

The book culminates more than four decades of legal practice by Unger. As a member of Parker Poe’s Land Development Services team, he counsels clients in the development, acquisition, financing, operation, sale and leasing of all forms of commercial, industrial and residential real estate. In addition, Unger is a frequent speaker and author on real estate development topics.

Treatise on the Law of Easements in South Carolina is available in softcover with accompanying CD version. The book can be purchased by visiting the SCB website at http://www.scbar.org/CLE-Books/CLE-Publications-Store.
