Earlier this month, the U.S. Department of Labor’s Wage and Hour Division issued a new fact sheet explaining the applicability of overtime exemptions under the Fair Labor Standards Act to occupations in higher education. While the fact sheet does not reflect changes in DOL’s position with regard to the exemptions, it reflects the agency’s current position with regard to a wide range of higher ed jobs.
Of particular interest to colleges and universities, the fact sheet discusses under what circumstances athletic coaches meet the definition of exempt teachers. It also lists specific examples of college jobs typically found to be administrative exempt, such as department heads, intervention specialists, and academic counselors. Finally, the fact sheet explains when student-employees such as graduate teaching assistants, research assistants, and student residential assistants qualify for overtime pay.
