Mike Adams was quoted in N.C. Lawyers Weekly on the growth of litigation finance, where investors help fund business lawsuits.
“Control is the key factor, the ability to control the decision-making in the litigation,” Mike said in the article. “For an opponent, that’s an important issue because you don’t have as much opportunity to interface with the third-party funder as you do with the party, who should be making all of the decisions in the litigation.”
Mike, who has litigated this issue in bankruptcy court, said that too much control by the third-party funder would run afoul of common law doctrines. He also said those agreements could make cases more difficult to settle.
