Sam Moses was featured in an article in Automotive News about the legal aspects of recruiting auto companies to open or expand manufacturing plants. Sam co-leads Parker Poe's Manufacturing & Distribution Industry Team.
"One of the emerging issues is in increased taxpayer transparency, which is putting much greater scrutiny on state and local incentive deals," Sam said. "In the past, sometimes communities were not really enforcing deals that were not really meeting up to their contractual obligations. A company said it would create 100 jobs, but it's only created 90 — in the past, the community might say, 'Well, even though it says 100 in the contract, our state has historically been pro-business. So we're going to work with the company to help them.' They don't want to be in the business of going after the companies and clawing back incentives. We see that attitude changing."
For that reason, Sam explained the importance of clients being very realistic with what they shoot for and promise. He also explained the role legal counsel can play as companies navigate the site selection process.
