Zack Anstett was quoted in The News & Observer on the Federal Trade Commission’s (FTC) proposal to ban noncompetes from employee contracts. Zack explained the value of noncompetes for employers.
“You have employers who invest in their employees and then provide them with the most proprietary and confidential information that the employer has,” he said. “It’s about that information, that internal know-how.”
The article discussed a practice called “blue penciling,” which is when courts remove aspects of noncompetes they find unreasonable.
“A court, in its discretion, could remove selected jurisdictions by simply crossing out the locations that would make it too broad,” said Zack Anstett.
