Title Company May Rely on Default Judgment of Quiet Title

Lauren Foster wrote an article for the American Land Title Association about how a title company may rely on default judgment of a quiet title. 

Lauren wrote about Crehan v. McGuire and a decision from a trial court involving an individual and a title agency.

"After the title agent flagged a cloud on title to the owner, the owner filed a quiet title action and received a default judgment," Lauren wrote. "It was then proper for the title insurer to rely on the judgment and issue title insurance. The title agent did not have additional duties under state regulations, such as conducting further research at the county register."
