David Pardue was quoted in IAM about a Texas federal judge's recent issuing of a preliminary injunction that prohibits enforcement of the Federal Trade Commission's new regulations banning most employment noncompetition agreements in the U.S. The judge's order applies to the named plaintiffs in the lawsuit.
It is important for companies to make sure restrictive covenants comply with state law and to use more than one kind of covenant to keep information and customers protected, David told the publication. This is because "a wait and see approach may be myopic in the end," he said.
