Employer Obligations When Workers Request Accommodations Related to Mental Health

Sherry Culves wrote an article for the Daily Report about the laws employers should be aware of when responding to a worker's request for an accommodation related to mental health. She also wrote about the duty employers have when responding to such requests.

"There is a universe of applicable laws when it comes to an employee seeking a mental health accommodation," Sherry wrote. "It is critical for employers not only to be legally compliant when responding to these accommodation requests but also to remain effective and functional, whether that’s in the classroom, warehouse or office."

"Employers should always keep in mind that determining the outcome of an accommodation request requires both an interactive process with the employee and an individual analysis of the situation," Sherry wrote. "Implementing across-the-board company responses without doing both of those things will land the employer in hot water."
