Noncompetes in the Crosshairs: Update on the Federal Trade Commission's Proposed Rule

A federal judge in Texas recently struck down the Federal Trade Commission's proposed rule that would have banned most noncompetes. The court concluded that the FTC lacked statutory authority to promulgate the noncompete rule under the Administrative Procedure Act (APA).
