David Pardue Quoted in IAM About Company's Petition for SCOTUS Review of Landmark Trade Secrets Case

David Pardue was quoted in IAM about a company’s petition to the U.S. Supreme Court to review a landmark trade secrets decision that has implications for companies. The decision in Motorola v. Hytera involved the extraterritorial reach of the Defend Trade Secrets Act, namely that the law can apply to an international trade secret theft if the facts of wrongdoing involve some footprint in the United States. 

The petition to the Supreme Court faces an uphill battle, David told the publication.

"Unless a petition cites a circuit split, getting permission to be in the front of the court faces tough odds," David said. Only about 5% of cases are granted certiorari. "Even a circuit split has to be important enough," he added.
