Noncompete Clauses in the Crosshairs

David Pardue wrote an article in IAM about how noncompete clauses for employers are in the crosshairs. 

"In 2024, the Federal Trade Commission (FTC) passed a rule banning most noncompetes that was ultimately enjoined by a federal court and, while the cases are not over, it seems unlikely with the change in administrations that the FTC will do much to keep the rule alive for the time being," David wrote. "No federal law exists on employment restrictions otherwise."

"However, the national conversation on noncompetes is not over," David continued. "As of March 2025, each of the courts to which the FTC appealed their loss have granted the FTC’s request to put those appeals on hold for 120 days. At a minimum, it appears that federal efforts to regulate noncompetes are stalled for the foreseeable future."
