Employers must adhere to federal and state minimum wage laws, ensuring that deductions do not reduce pay below legal thresholds, Jonathan told the publication.
"North Carolina, for example, characterizes overpayments as wage prepayment," Jonathan said. "Employers do not need advance authorization from employees for the deduction."
Jonathan also spoke about common causes of wage overpayment and how employers have handled these situations with workers.
"Typically, HR meets with the employee, explains the situation, and proposes a repayment schedule," Jonathan said. While companies may adjust repayment terms based on employee feedback, (the employer) is not legally obligated to do so."
