Lexi Trumble was quoted in NBC Sports about the Title IX implications for colleges and universities in the wake of the historic NCAA vs. House settlement. Approved by a federal judge on June 6, House allows all Division I colleges and universities to decide to compensate their student-athletes directly through revenue sharing.

There are important considerations regarding Title IX challenges and how backpay damages and revenue-sharing money among current and future athletes will be divided up by gender.

"We are waiting to see which school or schools are the first ones sued — not whether or not colleges will be sued, over their revenue sharing plans," Lexi said.

It is unclear how Title IX’s provisions will govern the revenue-sharing era until a court steps in, Lexi told the news outlet.

"At a certain point, schools have to consider what their risk tolerance is — how much legal exposure they’re willing to withstand, and how to balance that potential legal exposure as large or as small as it may be, depending on what level schools decide to compensate student athletes for their name, image and likeness," Lexi said. "For some schools that risk tolerance is going to be pretty high because they want to be as competitive as the powerhouse down the street. There are other schools that are going to play it extremely by the books, take a wait and see approach and figure out who’s getting sued and for what, so that they can pivot quickly."
