South Carolina Releases Poster Explaining New Pregnancy Discrimination Law

Earlier this year, we reported on a new South Carolina law that provides pregnant employees with legal protections that in some circumstances exceed those under federal law. In addition to these substantive protections, the new law requires employers to post a notice of employee rights. Last week, the South Carolina Human Affairs Commission released the form poster. In addition to a brief explanation of employee rights under the law, the poster advises employees on how to complain if they believe that their employer has not followed these requirements.

The poster can be found here. South Carolina employers should immediately include this posting along with other legal compliance notices. In addition to the poster, the new law requires South Carolina employers to directly provide new hires and current employees with an explanation of their rights. SCHAC has not released a model notice, and the agency has not started to enforce these requirements.
