Smith Podris focuses her practice on commercial and creditors’ rights litigation at both the trial and appellate level. She regularly handles the defense of lender liability claims, representation of creditors in bankruptcy court, prosecution of commercial foreclosures, and negotiation and documentation of commercial loan workouts. She is admitted to practice before the United States Court of Appeals for the Fourth Circuit, United States District Court for the District of South Carolina, and the United States Bankruptcy Court for the District of South Carolina.

Prior to joining Parker Poe, Smith served as a law clerk for the Honorable Karen J. Williams, who was then the chief judge of the United States Court of Appeals for the Fourth Circuit.

While at Vanderbilt University, she was the senior articles editor for the Vanderbilt Law Review and a member of the Moot Court Board.

Representative Experience

  • Assisted in obtaining favorable South Carolina Supreme Court ruling upholding a jury trial waiver contained in the promissory note and applying that waiver to causes of action including civil conspiracy, negligent misrepresentation, promissory estoppel, breach of contract/breach of contract accompanied by a fraudulent act, breach of fiduciary duty, fraud/fraud in the inducement, breach of contract/negligence, illegality of contract, and violations of the South Carolina Unfair Trade Practices Act 
  • Represented creditor in complex Chapter 11 bankruptcy proceedings resulting in a recovery in excess of 85% of the approximately $22,500,000.00 debt
  • Successfully defended lending institution against claims of negligence and breach of contract resulting from an incomplete spousal waiver related to an Individual Retirement Account
  • Achieved summary judgment and favorable settlement for judgment creditor where the corporate debtor’s assets were alleged to have been previously transferred out of the debtor and subsequently probated to family members
  • Represented commercial lender in the foreclosure of a multi-county development project, including the successful appointment of a receiver and advice regarding occupancy and environmental remediation issues
