Tension Between Legal Marijuana Use and Employer Rights

  • October 25, 2017

Charlotte attorneys Jonathan Crotty and Sarah Douglas wrote a guest column in Law360 about the conflicting laws employers face as more states legalize marijuana.

"On the one hand, a state legislature legalizes (and taxes) marijuana for medical or recreational purposes," they write. "On the other hand, the state continues to tell employers that they can fire employees for legal use of this substance. This conflict then causes confusion and consternation for legal marijuana users and their employers."

Jonathan and Sarah discuss recent state laws, analyze several court decisions, and detail some of the key things employers need to consider.
