Parker Poe Helps Secure Water Rights for Regional Growth

Charlotte, N.C. – Parker Poe Adams & Bernstein LLP recently secured a significant settlement for Union County, the Town of Wingate, and the Town of Norwood. The settlement ensures that an approximately $220 million water transmission and treatment project can move forward that Union County and others in the region are depending on to provide water to a growing population.

The North Carolina Environmental Management Commission had granted Union County an interbasin transfer certificate for the project. The project involves building an intake facility in Norwood on Lake Tillery and running 28 miles of pipeline through Stanly and Union Counties to a new water treatment facility to be built in Union County.

Four lawsuits were filed to stop the project, resulting in the potential for substantial construction delay costs and uncertainty. Parker Poe has assisted Union County, Wingate, and Norwood in dismissing one of the cases and reaching a settlement in the other three. The parties agreed to the final settlement in September.

“We are thrilled about this result for our clients,” says Steve Weber, leader of Parker Poe’s Environmental & Energy Practice. “On behalf of the collaborative team at Parker Poe who worked on this case, we want to congratulate Union County, Wingate, and Norwood, and thank them for the opportunity to help with this critical initiative for their residents.”

Parker Poe’s litigation team for the lawsuits included Steve Weber, Kevin Dunlap, and Merrick Parrott.
