“The main takeaway here is that whatever errors in compliance you make, they are likely to live with you a lot longer than they used to,” Eric said. “That is particularly true in the Fourth and Tenth Circuits, which had both adopted the first interpretation of the statute limitations, saying the longer limit did not apply when the government did not intervene.”
