Contemplating the Impact of the Bondi Memos on White Collar Defendants

Joel Schwartz and Scott Scheele co-authored an article in The Champion about the Department of Justice’s recent enforcement priorities, particularly as they impact white collar investigations of individuals, companies, and public entities. 

Joel and Scott wrote about Attorney General Pam Bondi’s memos, including one titled, "Ending Illegal DEI and DEIA Discrimination and Preferences" and includes a section on what to expect in antitrust enforcement by both the DOJ and the Federal Trade Commission. They also wrote about Bondi’s memo on elimination of cartels and transnational criminal organizations.

"One substantive area of the law directly affected by this memo is the government’s approach to the Foreign Corrupt Practice Act (FCPA) — which criminalizes payments or the like to foreign officials for the purpose of gaining an advantage that helps one get or retain business," they wrote. "The memo says that for at least 90 days, there is to be a prioritization of FCPA investigations related to foreign bribery that facilitates the criminal operations of cartels and TCOs, and a shift in focus away from those that do not."
