Parker Poe Advises Apex Clean Energy on North Carolina's Second Wind Farm

Raleigh, NC – Parker Poe Adams & Bernstein LLP is pleased to announce the firm’s role in advising Apex Clean Energy on Timbermill Wind, which will be the second utility-scale wind farm in North Carolina. Apex recently announced a power purchase agreement for the wind farm's full capacity: 189 megawatts.

Parker Poe, led initially by Henry Campen, now retired of counsel, and currently by Katherine Ross, represented Apex on state and local permitting, real estate, state and local tax, and economic incentives, and supported Apex on federal permitting and contracting. Parker Poe’s representation included counsel on the successful application for a wind siting permit from the North Carolina Department of Environmental Quality, a first of its kind. A team of over 20 Parker Poe lawyers advised Apex, including Merrick Parrott, Steve Weber, Tom Griffin, and Steve Hunting.

Timbermill Wind will generate tangible environmental benefits, including the contribution of approximately $190,000 to nearby conservation efforts, and inject significant local economic benefits as Chowan County’s largest taxpayer. The project will create approximately $33 million in tax revenue for the community, more than 150 jobs during construction, and a new source of income for local farmers and landowners.

Parker Poe’s Energy Team, led by Katherine, provides project development and transactional support to renewable energy developers, independent power producers, and investor-owned utilities, as well as companies and governmental entities seeking to develop or purchase clean energy.
